Frontline’s The Way the Music Died, which highlighted some of the key technological milestones of recorded music, had this to say regarding the “new” medium of radio; “When radio was first introduced in the 1930s many predicted the end of records. Radio was a free medium for the public to hear music for which they would normally pay. While some companies saw radio as a new avenue for promotion, others feared it would cut into profits from record sales and live performances. Many companies had their major stars sign agreements that they would not appear on radio.”
Fears such as these were not unfounded as profits in the music recording industry did indeed severely drop after radio was introduced.
Relying on pre-existing copyright laws, and buoyed by favorable precedent setting legal decisions such as suits involving the Bamberger Department Store and Shanley’s Restaurant (refer to The Elusive Symbiosis: The Impact of Radio on the Record Industry by Stan J. Liebowitz), copyright owners began to derive royalties from the “new” medium.
